COMPTON, Justice.

I. FACTUAL AND PROCEDURAL BACKGROUND

On September 16, 1984, Robert William Lord spent several hours at the Fogcutter Bar (Fogcutter) in Haines, Alaska. According to Lord, the bartender served him more than fourteen drinks from 1:45 to 10:30 pm. Lord left the Fogcutter with a woman, whom he subsequently kidnapped, raped and assaulted. He is currently serving a thirty-year sentence for these crimes. State v. Lord,
