MEMORANDUM OPINION AND ORDER

SPRIZZO, District Judge.

On September 28, 1990, defendant Gabriel Tejada entered a plea of guilty to both counts of a two count indictment: (1) conspiracy to distribute heroin in violation of 21 U.S.C. § 846; and (2) possession of heroin with intent to distribute in violation of 21 U.S.C. §§ 841(a), 841(b)(1)(B). Count 1 of the indictment carries a statutory mandatory minimum of ten years to a maximum of life imprisonment...
