This is a diversity case that started out as a zephyr of a collection matter for cement sold and delivered, and that freshened to a whole gale when the defendants filed a counter-claim for the torts of fraud and negligent misrepresentation, seeking compensatory and punitive damages, and also asserting a claim for breach of warranty, seeking, inter alia, lost profits.
