MEMORANDUM OPINION

This matter is before the court on Defendant Nutri/System, Inc.'s ("Nutri/System") Motions to Dismiss counts in Plaintiffs' Complaints alleging a violation of the Virginia false advertising statutory scheme of Virginia Code sections 18.2-2161 and 59.1-68.32, as amended. For reasons set forth below, the Motions to Dismiss are denied.
