Appellant David O. Altamirano (defendant) was charged with one count of sexual abuse, a class 5 felony, and one count of burglary in the second degree, a class 3 felony. The defendant entered into a plea agreement wherein count one of the complaint was dismissed and count two was reduced to attempted burglary in the second degree, a class 4 felony.
