This matter was tried on March 5, 1990, without the intervention of a jury. The following facts were adduced. The defendant, John K. Glenn, was charged with felony theft pursuant to R.C. 2913.02, as a consequence of his failure to maintain rental payments due under a rental contract involving the rental of certain times of used furniture.
