This case was heard before this Court in Denver, Colorado, on February 21, 1990. At trial, respondent's counsel orally moved to dismiss the case due to petitioners' failure to properly prosecute, failure to comply with the Tax Court Rules of Practice and Procedure, and failure to comply with Orders of the Court.
