This case comes to us on defendant Griffin's motion to dismiss the government's appeal.

FACTS

The defendants, Keith Griffin, Jackie Long and Robert Money ("the defendants"), pled guilty to conspiracy to interfere with civil rights after they were indicted for burning a cross in front of a black family's home.
