OPINION
ALARID, Judge.
Defendant appeals the judgment and sentence entered on his guilty plea of two counts of attempted criminal sexual penetration. On appeal, he raises two issues: (1) whether the trial court erred in refusing to dismiss the charges under SCRA 1986, 5-604, and (2) whether there was sufficient evidence to support the court's determination that defendant was competent to stand trial, plead guilty, and be sentenced.
