Plaintiff-Patricia Jackson ("Jackson") brought this action pursuant to 42 U.S.C. § 1981 alleging that defendant-Jackie A. McCleod ("McCleod") refused to hire her as a waitress in defendant's restaurant and that the refusal was racially motivated.
