The plaintiff, James A. Sharit, appeals from a summary judgment for the defendant, Jack Harkins, a co-employee of Sharit. Sharit had brought suit pursuant to Code 1975, § 25-5-11(c), alleging that Harkins had willfully and intentionally allowed employees to circumvent a safety device that was part of the gas torch that Sharit used on the job.
