This matter comes before the Court on a motion to dismiss pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure filed by defendants City of Cincinnati, Lawrence Whalen, Donald Andres, Chuck Beebe, and Steve Wong. (Doc. No. 7). Plaintiff Steven Fisher has filed a response in opposition to this motion1 (Doc. No. 16) and the defendants have replied. (Doc. No. 18).
