This matter is before the court on motion of the defendant, Island Creek Coal Company (hereinafter "Island Creek"), for summary judgment with respect to certain claims of sex discrimination.

The plaintiff, Thresa Kuhn (hereinafter "Kuhn"), has alleged that she was discriminated against on the basis of her sex when Island Creek refused to hire her for a number of positions available in the safety department...
