MEMORANDUM OPINION

MICHAEL, District Judge.

The matter presently before the Court is the motion for summary judgment filed in this case by defendant E. Darrell Jervey, III, on April 30, 1990. Thereafter, all concerned parties filed supporting and opposing legal memoranda on the motion, and on August 16, 1990, the Court heard oral argument on the motion.
