I. Introduction

This action arises out of the arrest and detention of plaintiff Ramon Ospina. In his complaint Ospina asserts a number of claims under 42 U.S.C. § 1983 and under Delaware law. The defendants in this suit include Robert Durnan, the Delaware State Policeman who made the arrest; Clifford Graviet, the Superintendent of the Delaware State Police; and the Delaware Department of Public Safety....
