MEMORANDUM OPINION

Plaintiff in this case seeks to recover funds which it alleges are owing to it under a loan participation agreement entered into by the parties. This action was originally filed in the Circuit Court for the City of Charlottesville and was removed to this court by the defendant pursuant to 12 U.S.C. § 1730(k)(1)(C).
