INTRODUCTION

Plaintiff Harter Corporation ("Harter") is a furniture manufacturer which is under investigation by the Environmental Protection Agency ("EPA") for releasing hazardous waste into the environment. The EPA has sent letters to Harter documenting hazardous waste from facilities which had received waste from Harter. The EPA has also indicated that Harter is potentially responsible for costs involved...
