KEENAN, District Judge:

Before the Court are plaintiff's motion and defendants' cross-motion for summary judgment. Fed.R.Civ.P. 56. Plaintiff Simon & Schuster, Inc. ("Simon & Schuster") seeks an order declaring that New York Executive Law section 632-a violates the First and Fourteenth Amendments to the United States Constitution.
