Joseph Lucero, the defendant in the trial court proceedings, was sentenced by the trial court after pleading guilty to one count of felony menacing. The court of appeals vacated Lucero's sentence in part, and the state filed a petition for writ of certiorari asking this court to review the court of appeals unpublished opinion. People v.
