OPINION

GREER, Judge.

Appellee was indicted on December 11, 1985, for two counts of child molestation. On June 27, 1986, a jury found the appellee guilty as charged. At that trial, the seven-year-old victim of both offenses testified and was cross-examined. On September 8, 1986, the trial judge granted appellee's motion for new trial pursuant to Rule 24.1, Ariz.R.Crim.P. The state filed a timely appeal in the matter, State v. Rodriguez, 1 CA-CR 10641...
