OPINION
BROOKS, Judge.
Appellant (defendant) was charged by indictment with one count of first degree murder. Following a jury trial, he was found guilty of second degree murder, as a lesser included offense, and was sentenced to an aggravated term of eighteen years' imprisonment. The sole issue on appeal is whether the trial court erred by refusing to give a jury instruction based on A.R.S. § 13-411.
