I. BACKGROUND

This case alleges federal and state securities violations, breach of fiduciary duty and professional negligence. Jill Wehe (plaintiff) alleges that defendants Merrill Lynch, Pierce, Fenner and Smith, Inc. (Merrill Lynch) and Donald Montgomery (Montgomery) failed to give her written statements disclosing the credit terms for margining securities.
