This matter is before the court on defendants Aspen Skiing Company's ("ASC") and Jennifer Catherine Lang's ("Lang") Motion to dismiss the Third, Fifth, Sixth, Seventh and Portions of the Fourth Claim For Relief Contained in Plaintiffs' Second Amended Complaint.
