The defendant was charged by bill of information with possession of marijuana with the intent to distribute in violation of La.R.S. 40:967. After the defendant waived his right to a trial by jury, the court found him guilty as charged on January 9, 1981. Thereafter, he was sentenced to four (4) years in parish prison.
