SCHOTT, Chief Judge.

Defendant was convicted of being a convicted felon in possession of a firearm (R.S. 14:95.1) and sentenced to four years at hard labor, a fine of $1,000 and six months in Parish Prison in default of payment of the fine.

On October 16, 1982 police officers McCaffery and Kopacz received a call that a man was waving a gun near Magazine and Austerlitz Streets in New Orleans. When they arrived at this location they saw the defendant nearby...
