Dorothy Ann Chapman sued John Clark and his employer Winn-Dixie Raleigh, Inc. (hereinafter collectively referred to as Clark) for personal injuries allegedly sustained when Clark, who worked at a grocery store, pushed a loaded produce cart into Chapman's hand, crushing her hand. The case was tried to a jury which returned a $290,000 verdict in favor of Chapman. Clark appeals, contending, among other things, that the trial court should have declared...
