This is a personal injury suit brought under the Federal Employers' Liability Act, 45 U.S.C. § 51 et seq. On April 6, 1989, the Court denied the defendant Railroad's Motion for Summary Judgment. The Railroad thereafter filed a Motion to Reconsider the denial, and plaintiff Giles filed a response to the Railroad's Motion to Reconsider.
