This cause comes before the court on the following matters: (1) the defendant's motion to strike the plaintiff's jury demand; (2) the defendant's motion for summary judgment; and (3) the court's order that the plaintiff show cause why this case should not be dismissed pursuant to Rule 41(b), Fed.R.Civ.P.
