Plaintiff United States of America ("plaintiff") brings this action pursuant to provisions of the federal Resource Conservation and Recovery Act ("RCRA"), 42 U.S. C. § 6901, et seq. and invokes jurisdiction pursuant to 42 U.S.C. § 6928(a) and 28 U.S.C. §§ 1331, 1345 and 1355.
