MEMORANDUM OPINION AND ORDER ADOPTING AND AFFIRMING MAGISTRATE'S RECOMMENDATION

THIS CAUSE comes before the Court upon Magistrate William C. Turnoff's recommendation regarding the Plaintiff's and Defendant's respective Motions for Summary Judgment. After a de novo review of the recommendation, any and all objections thereto, and the record, it appears that the Magistrate was correct in his decision.1
