The Commonwealth appealed from an order granting dismissal of complaints against the defendant due to interference with the defendant's right to counsel under the Sixth Amendment to the United States Constitution and art. 12 of the Massachusetts Declaration of Rights.1 We transferred the appeal to this court on our own motion.
