Plaintiffs Edward and Catherine Kirkland brought this civil action against defendant American Title Insurance Company ("ATICO") in the state court. Defendant removed this action to federal court based on diversity, and now moves pursuant to Fed.R.Civ.P. 12(b) to dismiss the action.
