Donald White, appellant, was charged and tried by jury in the District Court of Lincoln County, Case No. CRF-84-73, for the offense of Shooting With Intent to Kill on two counts. The jury returned a verdict of guilty for the lesser included offenses of one count of Assault and Battery in violation of 21 O.S. 1981, § 641, and one count of Assault and Battery With a Dangerous Weapon in violation of 21 O.S. 1981, § 645.
