In its Memorandum Opinion of January 25, 1988, this court denied Continental's motion to dismiss Allied's action to enforce a stand-by letter of credit ("the Letter of Credit"). Allied v. Continental, 87 C 5270 ("Opinion"). The Letter of Credit permitted Allied to seek payment from Continental as soon as Allied incurred liability under surety bonds...
