Before the Court are motions by defendants in three cases which involve disputes arising from the construction of the Rehoboth Mall in Sussex County, Delaware. Plaintiff in all three cases is J.A. Moore Construction Company ("Moore"), which was general contractor for construction of the Mall. Moore has brought two actions, now consolidated, based on breach of contract, quantum meruit and fraud,1
