MEMORANDUM AND ORDER

BATTIN, Chief Judge.

On December 30, 1985, plaintiff filed an amended complaint against First Interstate Bancsystems of Montana, Inc., et al., seeking a declaratory judgment. By its complaint, plaintiff sought a declaration that it had no duty to indemnify and defend the Bank in a wrongful termination suit filed by a former bank employee in state court. By Order dated July 13, 1987, 664 F.Supp. 1390
