This is an appeal from a summary judgment granted in favor of the City of Galveston and the County of Galveston. Kenneth and Audrey Woomer sued under the Texas Tort Claims Act and the Texas Wrongful Death and Survivor's Statutes, alleging that appellees' negligence proximately caused the drowning death of their son, Richard Scott Woomer ("decedent").
