Memorandum Findings of Fact and Opinion

POWELL, Special Trial Judge:1

This case is before the Court on petitioner's Motion To Suppress and To Shift Burden of Going Forward. The basic question is whether the notice of deficiency was based upon improperly disclosed grand jury materials. For the reasons stated below, we find that there was no improper use of grand jury materials and deny the motion.
