PANNER, Chief Judge.

Curtis Melton Sanderson, an Oregon inmate, brings this habeas petition under 28 U.S.C. § 2254. He alleges that he did not voluntarily plead guilty and that the state trial court improperly failed to appoint him counsel. The parties cross-move for summary judgment. Magistrate Michael R. Hogan filed his Findings and Recommendation on January 14, 1988. The matter is now before me pursuant to 28 U.S.C. § 636(b)...
