POPOVICH, Chief Judge.

Respondent's driver's license was revoked for an implied consent violation. He petitioned for judicial review, and the trial court rescinded the revocation. The Commissioner moved for a new trial, and the trial court denied the motion. The Commissioner appeals from the order denying the motion for a new trial.
