In this matter involving the people's appeal by leave granted August 1, 1985, we are asked to determine the constitutionality of the ticket scalping statute, MCL 750.465; MSA 28.720. Both the 52nd District Court, 4th Division, and the Oakland Circuit Court held the statute unconstitutional on grounds that it impermissibly delegates legislative authority to private individuals.
