This action was brought by the United States of America pursuant to the Surface Mining Control and Reclamation Act of 1977 (hereinafter the Act), 30 U.S.C. § 1201 et seq. The plaintiff seeks a permanent injunction enjoining the defendant from conducting, or engaging in the conduct of, surface coal mining operations without first obtaining a permit.
