This negligence action was brought by Paul and Marilyn Ruppert against David Yaeger for injuries allegedly sustained in a boating accident. After the jury verdict, the Rupperts moved for a new trial pursuant to Minn.R.Civ.P. 59.01 (5) and (7) or, in the alternative, for judgment notwithstanding the verdict.
