Plaintiffs Frank S. Kasper, Jerome J. Kasper and Acme Propane, Inc. (referred to collectively as "Acme") filed this action seeking damages for alleged securities fraud. Defendants Tenexco, Inc., Richard S. Incandela, Energy Funding Company, Inc. ("Energy") and Ronald S.
