Defendant was tried upon a proper indictment issued 14 January 1985 charging him with (1) first-degree rape, G.S. 14-27.2, and (2) taking indecent liberties with a minor, G.S. 14-202.1. Defendant was convicted of taking indecent liberties with a minor and sentenced to the presumptive term of three years in prison. On appeal defendant alleges (1) that the trial court should have granted his motion to dismiss the indecent liberties charge against him...
