Defendants Frederick Weisman ("Weisman"), Frederick Weisman Co. ("FWC"), and Rare Properties, Inc. ("Rare Properties") have moved for an order dismissing the complaint pursuant to Fed.R.Civ.P 56, or, alternatively, for an order dismissing the complaint for plaintiff Sachiko Bower's ("Bower") misconduct pursuant to Fed.R.
