This matter is before me on defendant's, the Federal Deposit Insurance Corporation ("FDIC"), motion to dismiss pursuant to Rule 12(b)(1) and 12(b)(6) of the F.R.C.P. Defendant's motion is based upon the lack of subject matter jurisdiction and the failure to state a claim upon which relief can be granted.
