This matter is before the court on defendant's motion to dismiss the complaint for failure to state a claim upon which relief can be granted and for lack of jurisdiction. In October 1985, plaintiff filed applications for disability insurance benefits and SSI benefits under Titles II and XVI of the Social Security Act.
