This is an appeal from the lower court's order denying appellant's petition for relief under the Post Conviction Hearing Act (PCHA), 42 Pa.C.S.A. §§ 9541-9551. Appellant contends that appellate counsel was ineffective for failing to argue on direct appeal that the sentencing court abused its discretion by considering an impermissible factor when it imposed sentence.
