Appellants in both of these appeals are teachers who were laid off from their teaching positions, ostensibly because of declining enrollments, and then offered half-pay positions pursuant to the provisions of an Early Retirement Incentive (ERI) program negotiated between the Board of Education for the Garden City School District and appellants' union.
